Do I always need a Grant of Probate?

In many cases a Grant of Probate (or Letters of Administration if there is no Will) is required to release money from banks, sell property, or deal with investments. However, smaller estates or those with joint assets may not need probate. We’ll review the estate with you and confirm whether probate is required before you instruct us.

Who can apply for probate?

If there is a valid Will, the executors named in the Will are usually the people who apply for probate. If there is no Will, the closest living relative (for example a spouse, civil partner or adult child) can typically apply to administer the estate. If you’re unsure whether you’re the right person, we’ll explain your options clearly.

What is the difference between probate and estate administration?

“Probate” usually refers to obtaining the legal document (the Grant) from the court. “Estate administration” is the wider process of valuing assets, settling debts and tax, closing accounts, and distributing inheritance to beneficiaries. We can help with just the probate application or the full estate administration — it’s your choice.
